I have a residential land in RR Nagar Bangalore, which is under litigation. Have checked with legal council

Q: I have a residential land in RR Nagar Bangalore, which is under litigation. Have checked with legal council and there is no stuff in the case and I am also convinced. But, it is matter of time before this case is settled. Khatha is in my name and I am not able get Khatha extract which is prerequisite for plan approval. Hence, BBMP is not giving approval for my building plan. Due to which I am not able to approach any bank for housing loan.

Is there any bank (nationalized or private bank) which is ready to provide loan in the absence of approved plan from BBMP?

Thanks Murali, I had done those procedures mentioned in your reply above within few days after I purchased the property four years before and all related documents are already in my name.

As mentioned in my question above, the Khata of my land is A Khata with all betterment charges paid. Further the layout where my land is there is also approved by then BDA and land tax is also paid up to date. The seller from whom I purchased had in turn purchased the same in a bank auction and I have already taken loan from bank for purchasing the land. The concern is due to court case (which has come up after the property was purchased by me) the BBMP is not issuing latest Khata extract (I have khata extract but the same was issued four years before) without the extract I will not able to apply for plan approval. I am not looking for ROI it's notional as I not intention of selling.

I agree with above reply. Yes, it is possible to transfer Khata to your name. In order to get this done, one has to go to the BBMP office and apply for Khata transfer with the required set of documents. For transfer from "B" to "A" Khata and change of name in Khata, the owner of the property has to give a letter of requisition along with the title deed and the latest tax receipts to the Assistant Officer of the sub-division or range.

Hi,
First check your Khata Extract, whether it comes under "A" Khata or "B" Khata. If it comes under "B" Khata then you will have to transfer it into "A" Khata from the concerned Authorities. Once getting the approved plan from the BBMP then only you can avail loan. In absence of approval no bank will provide you loan. And it will be a legal if you construct home in a unapproved plot.

Registration under "A" Khata is necessary to avail any property loan or to construct as per the building bylaws of the jurisdiction of the property. Under the residential plotted development, ROI largely depends upon two parameters. Firstly, to get maximum returns, the plot should be DC converted and have its layout approved from BMRDA. Secondly, the plot should have "A" Khata status under the BBMP register.
