All construction near jails must need NOC in Maharashtra

Q: Attention citizen !!!!! Maharashtra Government has made it compulsory for citizens to get a no objection certificate from a special committee to construct anything within 500 meter radius of a prison.

as said, any new redevelopment of building is proposed in the 500m radius of prison then what guidelines as an architect do we have to follow? there are some approval members in planning committee says to have a blank wall all throughout. which is not possible in the city like mumbai and specially in a redevelopment building in a place like chorbazar. kindly let me know if there are any such rules that an architect or a developer will have to adhere to.

Order or govt circular is in action since one year. They are not giving any permisions in 500 meteres from jail outside wall. The commitee is formed everywhere but with no guidelines on how noc should be given.

Hi Naganath,
This is India dear here every order is made for paper only.....not for action. It is also came to know that New buildings around city's jail will need NOC of the three-member committee. As there is no prison in metro region, new construction will not require any such NOC.

i heard the news this morning. Is the constitution of the committee different for different planning bodies? How many member will be there in Municipal Council and Municipal Corporation?

Yes Devesh,
There will be a different committee for different planning bodies. In case of municipal corporations, the committee will have 3 members - municipal commissioner, police commissioner and deputy inspector general of prisons. The municipal commissioner will be the chairman.

And in case of municipal council, the committee will have 4 members - district collector, chief executive officer of the council, police commissioner or superintendent of police and DIG. The district collector will be the chairman.

I don't know why an idea for safety of prisoners came in to state government's mind? Is there any specific reason that? I am very curious to know the fact.

Well Mani,
As i know, a citizen had filed a case in Bombay High Court seeking to know whether or not government was taking any actions for safety of prisoners. Responding to this, the urban development department issued this order.

I think till now, no objectives have been laid down for the committee to decide cases, which has raised a fear that members may act as per their wish and choices.

But, it is came to hear that a special committee will determine whether the building creates any danger to prisoners. It will accordingly advise the planning authority.

Has UDD instructed all planning authority to think about the guidance of the committee before sanctioning the building plan? What will happen if the planning body does not agree with the committee?

Yes, the UDD has instructed all planning authorities to thoroughly think about the guidance of the committee before sanctioning the building plan.

On the other hand, if the planning body does not agree with the committee it can approach the home department with a detailed explanation. The home department will discuss the proposal with UDD and then inform all concerned about the government's decision.
