Generally when someone wants to build a structure on a land and avail a bank loan for the construction process, they need to obtain Non-Agricultural certificate. This certificate confirms whether the land is unfit for cultivation or not. Under laws stated in Maharashtra Land Revenue Code, land must be deemed non-agricultural before any development is allowed on it. This certificate allows the user to convert the land from agricultural to non-agricultural. This is often also required to convert the use of land from one non-agricultural purpose to another non-agricultural purpose.
Following documents required while applying for Conversion depend upon LRT Land and Patta Land.
For LRT Land:
a. R.T.C. in 3 copies.
b. Sketch of the land in 3 copies
c. Certified copy of Land Tribunal Order.
d. Certified copy of Form-10-Occupancy right.
e. Zonal certificate from Urban Development Authority/Town Planning Authority along with the opinion.
f. Title Deed (Back Documents)
g. No Dues Certificate issued by Village accountant.
h. MR order copy
For Patta Land:
a. Certified copy of the document of the land which the right has been transferred to applicant.
b. Sketch of the land in triplicate.
c. R.T.C. in triplicate.
d. No Dues Certificate issued by Village accountant.
e. MR order copy
Process for those applicant who are direct owners of the land is as follows: 1. Land owners will have to seek the permission of the municipal body for their non-agricultural plans. 2. Once the municipal corporation or municipal council gives the go-ahead, the owner just needs to intimate the collector in 30 days. 3. No permission from the collector is required. Revenue officials will then recover a one-time land conversion tax and a non-agriculture cess
Hi Arthi, I think you should take the permission of the municipal body for their non-agricultural plans. If the land was confirmed by occupancy right in the Land Tribunals As per Maharashtra act, Deputy Commissioner is the authority to issue conversion order. For other lands i.e. Patta lands, Tahsildar is the authority to issue conversion order.
Application should be in prescribed Form-I for Land Reforms tenanted Lands and Form No.21A for Patta lands and it should be submitted to the Tahasildar concerned.
Hi Rahul, I think by default all lands are agricultural lands. Except for agriculture purpose, permission is required for non-agricultural purposes like Residential, Commercial etc. which is known as Land Conversion i.e. alter the status of land from agriculture to Non-agriculture.
Hi Rohit, In this regards Maharashtra government has decided to simplify conversion of revenue land located within the development plan area of major cities in the state from agriculture to non-agriculture status.
