Is there any way to get the security deposit back from flat owner?

Q: I had a bad time in vacating the rented apartment in AWHO, Gurjinder Vihar, Greater Noida. Flat owner has clearly said NO to return my security deposit and falsely made claims that I have damaged many things and now he will get them repaired. looking for any remedy to get my hard earned money back. Can any body help?

Hi Sanjeev,
I ran into similar issues with my landlord regarding the security/advance deposit which I had paid as a part of the rental agreement. As the advance amount was quite high (Bangalore rents are atrocious!!), I decided to take a legal opinion. I found a good lawyer on www.ZippServ.com who helped me send a legal notice to the owner.
(https://www.zippserv.com/personal-legal/legal-notice.html). For a couple of thousand bugs the notice was sent and within a few days the owner returned the balance advance money owed to me. Hope this is helpful.

Yes. I gave notice of 1 month as per agreement and I had very good relation with flat owner till the notice of vacating. Since, they are old couple so did not use force to get the money back. However, they have added many things under repair, which were not damaged by us and they were visiting the flat very often and never objected on any thing damaged. Therefore, I faced this situation otherwise I would have forcefully taken back my money. Any advise further?

Sir,
"'Forcefully taken back money" is not advisable. Always go as per the agreement terms & conditions. Evaluate the repairing cost & see whether it exceeds the amount they applied for or not? You can ask them not to charge more.

If you have the rental agreement then it is easy for you to recover your security deposit money from the flat owner. Because the full process must be written there,you could check that.

Now come to damage part, note down the damages need to repair. Then evaluate the cost of repairing, which is valid. Then you should claim the rest of money from your flat owner. .

Hey Sanjeev,
Have you notified your flat owner before vacating the flat? Because in the agreement, it must be mentioned that at least 1month before vacating the flat, you should inform the owner, or else owner will deduct one month rent from your deposit.
