MoEF proposed new watchdog to determine the effectr of environment damage

Q: Adding another step to the lengthy green clearance chain, a new watchdog has been introduced to control the the impact of environmental damage to be caused by any project.

Good Morning Amreesh,
The National Green Tribunal was established in 2010 for expeditious disposal of cases relating to environmental protection and conservation of forests. It can penalize, order status and restoration of damaged environment.

MoEF proposes and adjudicating authority to determine if violation is minor, non-substantial or substantial. It also proposes, draft bill not clear on what basis the distinction can be made.

@Saran,
As per advocate Godfrey Pimenta, there is no need for a new authority to decide on environmental damage. Section 15 of the NGT Act is sufficient to allow relief to victims of pollution as also compensation for the property damaged and compensation for environment of such area.

Hello Amreesh,
It's duty will be to determine whether the damage is minor, non-substantial or substantial and decide on a monetary penalty. The draft Bill is not clear on what basis the distinction can be made. Its decision can be challenged before the NGT.

Hi kaushik,
Actually, they plans to revise the Environment Protection Act, 1986, and the National Green Tribunal Act, 2010, with the objective of providing for an effective defensive penal and introducing the idea of monetary penalty for violations and practice.

Protester bang on the ministry of environment and forests proposal as a intentionally attempt to choke the National Green Tribunal, which has been motivating in protecting the environment.
