Is it true that this builder has changed the site plant without the consent of buyer and now asking for more money.

Q: On the CIDCO website there is a CC of this builder with different site map. In 2012 it promise the buyers to have their flats in 2015. Now in some other site possession date is shown 2018. He has cheated earlier buyer by changing the site plan without their knowledge and consent. Sai Provisio County, Panvel is cheat project.

Hi,
As per Section 7 of the Maharashtra Ownership of flats Act, after the plans and specifications of the building, as approved by the local authority as previously mentioned, are disclosed of furnished to the person who agree to take one or more flats, the promoter shall not make any change in the structures described therein in respect of the flat or flats which are agreed to be taken, without the previous consent of that person. It is consider as a criminal offense and you have right to file a case against the builder in consumer forum. Similar clause exist in apartments acts across country.

Hi Vinay,
I think these issues are even more in the northern part of India and seems like they still exist even after SC's stamp on it. This has already been incorporated in the Real Estate bill 2015 but still waiting for its final approval from Rajya Sabha.

This order will help future home buyers and would finally mean that the buyers would end up getting what they initially signed up for and if there are possibilities of change to the original plan, even then the buyers would be a part of that change in decision. Am i right ?
