Q: Q. During Oct 2013, A builder has launched a Project with 20% and 80% scheme. I paid 20% and received the allotment letter. Up to now, the said builder has not started any development and there is no hope that he will start the construction very soon. During the several meeting he highlighted many technical and financial issue. Now my question is if i terminate the agreement and request for the refund, will i get the benefit (interest) on my 20% deposit? What is the best way to get the refund?
Hello Ismail, For this you will need to first and foremost issue a legal notice through an advocate asking for cancellation and refund of your entire monies together with interest, all of this to be complied within 15 days. After the lapse of 15 days, if the builder fails to comply, then proceed to file the consumer complaint against the builder seeking refund with interest and litigation expenses along with compensation for Deficiency in service.
Hi Ismail, Issue a notice to refund the booking within the given time, if builder did not reply positively then file a suit for recovery of money with compensation. You will have to pay the court fee on the claimed amount.
You have two option there First to file consumer complaint for deficiency of service on the part of builder by claiming back your earnest amount along with claim of compensation.
Secondly you have option to file civil suit for recovery of amount so given by you as earnest amount.
