@Akhilesh,
But i heard that this land parcel belongs to government which they have handed over to MHADA for construction of houses for lower and middle class people. And as per judicial note, any govt. land for which some scheme is launched for a public cause, it is stalled immediately either by slumlords or by encroachers by approaching the court and misrepresent the facts and documents.

@Mritunjoy,
I think these attempts are required to be defeated, otherwise public cause gets spoil and the land is grabbed by encroachers illegally only on the basis of muscle power. So, the HC said that it was the duty of the court to maintain the rule of law to ensure that govt land is protected especially when it is reserved for a public cause.

Such kind of forgery can be removed by imposing ideal costs on the builder, considering the damage to the public cause and state wealth. Both Shinde and the builders are guilty and fake. Their main intention was to grab the land with the help of some govt employees.

They found guilty and the court asked the developer to pay Rs. 1 crore as cost to MHADA within 4 weeks and allowed the agency to initiate action against the slum dwellers who have encroached on the property.

Yes, the observation came in a case where the high court fined Gundecha Builders Rs.1 crore after dismissing its claim over 50 acres of prime land in Goregaon West. The value of the property is Rs.500 crore. Which is considering as a fake deal.

I read this news. A 36 year old litigation initiated by a man who claimed himself as a owner of the land since 1944. While Gundecha Builders is saying that it had bought the land in 1979 from Shivram Shinde and demanded the evict from the property of MHADA, which is proposing an affordable housing project on it.
