In Navi Mumbai, @ possession builder asking maintenance amount in cash and refusing to give receipt for it, what to do?

Q: In Ulwe, sector 17, for Om Sai Shrushti by Platinium group

Argument by this builder is that they are partnership firm, and can not open escrow account for maintaining maintenance amounts from members of this project. Further their argument is that it is mentioned in sale agreement that "purchaser will pay maintenance amount before taking possession". Since on receipt of maintenance amount, they will give possession of the flat, so it is understood that buyer has paid the maintenance, so no need for them to give separate receipt for maintenance amount.

My concern is after giving maintenance amount & taking possession, they should not later demand maintenance amount again.

Hi Imtiyaz,
No, you can not pay any charges in cash and without any receipt. If your builder is not ready to give the possession, file a case against him asking him maintenance charges without any receipt. A receipt is a copy of your proof that you have paid the maintenance charges for your flat. So, don't pay him in cash.

Yes, Ananya is right. You builder is very clever. He wants to save tax on it and it is illegal. If you have a receipt copy of paid maintenance charges then you can claim for return filing.
