query regarding exemption of stamp duty

Q: Respected Sir
With due respect, I want to ask a query that When unmarried lady is transferring property(urban/rural residential) to her sister's daughter. Can exemption from stamp duty and registration fee be claimed here? If yes, Kindly send the supporting documents at akalharpreet@gmail.com.
Related to punjab state. Kindly reply as soon as possible.

Thanks for the reply. I already explored the punjab revenue website and also consulted some experts and also want to put forward this crucial knowledge in front of you that their is no stamp duty in the case aforementioned above.

Kindly refer to the notification S.O. 20/C.A.211899/S.9/2007, dated the 27th April, 2007.

Hi Harpreet,
The stamp duty for a gift deed is usually much lower than that for a sale deed because of the lack of a taxable price being paid for the property to be transferred. The applicable stamp duty in Punjab varies between 0.5% to 6% as the state is in the process of amending its Stamp Act for gift deeds.

Visit your nearby Collectorate Office or Land and Revenue department, they will provide you the latest info on it. Better, you take the advice of a legal expert on it.

Hello Harpreet,
No, you can transfer your property to your sister's daughter but you will not get any exemption on stamp duty. You will only get exemption on stamp duty if that property is transferred to blood relations. You can gift her and for that you have to pay nominal charges.

I am agree with Samarjit.
Earlier, blood relationship, the brother-sister relation was not included in the category of people eligible for remission of stamp duty and they had to pay full stamp duty on such transactions. Now, any transfer between brother and sister and vice-versa would not attract any stamp duty.
In such situation you you can gift your property to sister's daughter and go for gift deed where you have to pay nominal charges for making gift deed.
