Delay in Position by Rustomjee

Q: Am facing delay in position of my flat in G Wing Azziano for more than 1 year.
and wanted to have the delay compensation as paying rent for current house.
any one facing same delay issue ?

Hello all, We too have booked a flat in 2014 in Azziano G wing. We were promised possession in Dec2016 but we checked it out today, and 10 months later, they are nowhere near completion. They have tentatively given us a few dates. Dec 2017 is when they plan to apply for OC and Jan2018 is when they say they will give out possession for wings F, G, H ... devoid of the podium and clubhouse for which they intend to unfailingly charge us in the full and final demand.

The massive waste of our funds notwithstanding, our agreement contracts allow them 12 months of grace period post the promised date of Dec 2016 post which we are entitled to a refund and compensation.

What do your agreement contracts say.

I wish that we as future residents form a forum so we can make joint inquiries in the near future and impose on them the urgency and need to obtain possession as promised and follow through on the compensations promised otherwise.

Hi Anil, I am also waiting for my position in Rustomjee G wing and it has already been delayed by 9 months. Did you manage to claim interest or refund?

As per Real Estate Regulation Act (RERA), builders will have to pay 10.9% per annum for delayed possession. In case a buyer is seeking a refund on the entire payment at the sale rate , and the builder will have to repay the amount within 45 days of a claim being made.

HI,
If possession is not delivered on time, a buyer can send a notice to the builder, claiming refund of the amounts paid along with interest and/or damages. The buyer can also file a consumer complaint for deficiency in service as defined under the Consumer Protection Act, 1986 against the builder.
