I am living in a tenanted property, since 61 years, Landlord is refusing to add my children name,what should I do

Q: My father bought this rented (Paghdi System) flat in 1956, and in 2012 it transferred on my name. Now I wish to add name of my legal heir and or sell the property. Landlord is refusing to add any name .
Secondly if I want sell the property, how do I sell , as landlord is givng me peanuts , is any legal way to sell

I agreed with Viabhav. The landlord has misled you by saying that you need to pay 33% of the market value of the property to have the name transferred.The transfer charges are very nominal. The amount equivalent to 33% of the market value of the property is required to be aid by you only in the event you propose to sell the property and not otherwise.

Hi Lalit,
You cannot transfer the tenancy to your children name without the consent of the landlord. Under the Pagdi System, you have to give 33 % of the sale value to your landlord if you choose to alienate the property to a third party. In the event you sell it during her lifetime landlord will take 33 % of sale proceeds.
