I made rental agreement with owner but that is expired after 11 months. After that I am paying same rent.

Q: Same rent paying after mutual agreement with owner. But suddenly he demanded 5% arears of all previous years and denying mutual agreement. Kindly advise.

Hi,
Within the provisions of the agreement, a rental agreement can be granted retrospective effect. Stamp duty charges, on the other hand, cannot be retroactive.

For a rent agreement format, who should purchase stamp paper?

The stamp paper can be purchased by either the landlord or the renter, and it will remain the property of the purchaser. You must purchase the stamp paper yourself if you wish to own an original agreement. Otherwise, you might request a photocopy or scanned copy from the other party.

Hi,
There is no such rule that the rent will increase automatically after the agreement expires. This can only happen if the owner has mentioned this clause in the lease agreement. Therefore always read all the clauses in the agreement carefully and discuss with the landlord regarding this.

Whatever mentioned in the last years agreement is full and final and you do not have to pay arears of previous year. As the rent amount is clearly mentioned in the agreement. Landlord can not force you to pay.

In Bangalore, landlords ask every year to increase the rent at the rate of 10 percent. But there is no rule that you will have to pay arears of all previous year. You may convince him saying that you are ready to increase the rent from the current year at the rate of 5 percent. If he is not ready then change the flat and look for better options.
