Well Shiva, A model road should have proper footpaths without any encroachments, should have proper parking facilities, no pothole or open drainage, proper signals and zebra crossing.
Thanks for the useful information, Do you think that BBMP will develop the model road within the given period? How will they handle the street hawkers? Is there any other direction given by the High Court to BBMP?
Yes, They can. Becausethe court asked BBMP to refer one officer for this and in the end, make it a practice. If such steps are taken, pollution, which is high in many congested areas of the city, will automatically be reduced. The bench ordered BBMP to submit photographs of the work on the model road at the next hearing. Even the court asked the state government to submit year-wise data on cancer patients admitted to hospitals due to pollution.
Street hawkers can be removed as per the Karnataka Municipal Act.
Hi all,
Another news came into existence that BBMP has given a 15 days bench mark for the model road by High Court. The High Court asked the BBMP yesterday i.e. 7th of November'2014 to pick a city road and change it into a model one.
Hi Priyaranjan, The step was taken by the High court after hearing a petition on the increasing air pollution levels in the city. The petitioner said apart from vehicle smoke, dust settled on the road adds to the pollution and make the air pollution.
In a reply the BBMP counsel presented that the civic body was taking action to ensure that the roads are swept properly. But the court is not agree with them and handed over a list of road to BBMP and choose one to make it a model road.
In a straight manner the court has now asked the BBMP chief to submit a report along with photographs of the area and road in relation to action taken in the matter. He was also asked to furnish the show-cause notices issued to guilty officials.
Even in his reply the BBMP chief informed the court that a special officer would look after eviction of aggression on footpaths, apart from change the structure and resurfacing of footpaths, wherever necessary. In his reply the court directed him to file a progress report by November 25.
@Rameswari, The court was surprised when the commissioner admit that he had not read amendments to Sections 256 and 257 of the KMC Act, relating to discontinuity and collection of waste, brought about in 2013. He also admit that he had not issued a single notice so far under the recently amended provisions of the Act.
It means when next time we drive home from the international airport is delayed, blame it on Bruhat Bangalore Mahanagar Palike (BBMP). Because, the civic body has deformed rules of road widening project and created blockage or congestion.
Do you remembered when a PIL filed in 2007 on roads and footpaths invade by shops on Subedar Chatram Road and Yeshwantpur Railway Station, the court was taken aback that even after employing pourakarmikas and five tables of officials for supervision, the situation remains the same.
Salary for doing nothing?
Hi Karthik, Not only this but also advised the BBMP chief to weed out non-performing assets in the civic body. Observing a total failure to fulfill a responsibility on the part of civic officials.
Do you know that earlier, the bench also asked the BBMP chief what steps he had taken to ensure the rights of hawkers as established in the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014.
Yes, i know........ And when the BBMP chief replied in the negative, the bench asked him that what prevented him from doing that exercise? Once the city known as pensioners' paradise, has now become a hawkers' paradise. They can set up business anywhere disturbing the common people.
The Karnataka High Court on yesterday i.e. 05.11.2014 told the Bruhat Bangalore Mahanagara Palike (BBMP) Commissioner, M. Lakshminarayana, that that there is complete lawlessness right under his nose. And further questioned him whether he had the courage to suspend or dismiss officials related for their slackness in maintaining footpaths.
