The walls in my 2 bathrooms are damaged due to the water leakage from the upper floor bathroom in my apartment complex. The owner from the top floor is not ready to pay for the repair cost in my flat. What is the procedure to file a case and get the compensation. In what way association will help or are there any association by-laws which can handle this kind of situation and help the owner affected by the water leakage from the top floor. Regards VV

I have the similar problem for my apartment in JP Nagar. Here the owner of top floor flat wants me to pay the problems in their bathroom as we are the sufferers due to seepage to our flat. This looks more unfair.
Can someone suggest the steps for filing the case, who to approach. And the details of bye-law. We do not have any registered association.

Before filing a case, write a letter to the association and request them to repair as soon as possible. After 15 days of time, if no action is taken, seek legal expert advice and show the copy of letter you sent for requesting the repair service. If there is any leakage or repair service is required it is duty of association or property manager to get repaired because such service comes in maintenance of the building. Filing a case should be last resort. First try to solve by mutual understanding or as per bye-law of association.
