Help needed to get advance money back from the room owner

Q: Hi,
We stayed in individual house for 10 months. As per the agreement, 1 month before we vacate this room we should inform the room owner and according we informed our room owner with 1 month prior notice. Now my room owner is saying unless tenants come to this house he cant return our advance money. He is asking us to vacate this room and after that when tenant will pay him advance money then only he will return it. We also told unless u return our money we won't vacate this house and he told then again you have to pay extra money for that. Would anyone please give me some legal advice so that we get our money back soon and get rid of this problem?

No point in fighting now, no issues have ever resolved with fights, the history says that, (not me)...

Politely agree to vacate the premises taking a PDC of 10 days and also try to help him finding a tenant to achieve your goal...

Otherwise you are free to keep fighting and wasting your precious time

In Bangalore the rental agreement is made for 11 months and if you are vacating the house before that the house owner will deduct some of the amount from the advance.

If the owner insists that he will the advance after finding new tenant then do one thing.. Ask him to give a written proof for the same. Or you ask him to mention within 2 or 3 months he will pay it back.

Usually agreement is made for 11 months then how can you vacate before that? How much advance money he has to give back? And have you paid this month's rent?

When you informed your owner one month ago, did you mention that you need advance before vacating? Or did the owner tell anything about it?
