Power of attorney

Q: Sir. I want to make a power of attorney on my wife name so that in absence of me she can sell the house . How much value of stamp paper should I buy and which one is better GPA or Sale Cum GPA.

Yes it is necessary. It is mandatory to get endorsed any document from their respective Indian Embassy. If you send the POA,kindly note that it requires to be registered at Registration Office in India of your father's residence with a fee of Rs 200/ or so and he can use it as and when required and please do not go for General Power Of Attorney but the specific one for the specific transaction.

Hi, I am USA based NRI. I am planning to purchase an apartment in India. I want to give my father the power of attorney to purchase on my behalf. I got a format from the builder. Do I need to get the POA notarized from Notary public or getting attested from Indian embassy in USA is mandatory ?

When you are only giving only power to sell the house then go only for GPA not sale cum GPA.Rs 100 bond paper is enough the stamp duty will be less.In your case You have to go for Special power of attorney as you are giving special power that is power to sell to your wife its not for general purpose.Your\'s will be special power of attorney.

You can make sale cum GPA on rupees five hundred, stamp paper,and duly registered it, then your wife can sell the the house on behalf of you.

As per my knowledge, the Power of Attorney in Maharashtra is required to be executed on a Rs. 500/- non-judicial stamp paper.
