Q: Can someone explain the PROS and CONS of buying property by giving Power Of Attorney?

Latest Answer: The drafting of General Power of Attorney has to be made with great care and precision, where valid reasons for issuing the powers have to be stated. Any wrong use of words can jeopardize your position and can cause greater harm.

Q: I have bought an under construction flat in Bhubaneswar and I am hearing I might be called for registration. But I am currently located in USA and cannot be present physically to register. Do I need to prepare Power of Attorney to someone to do the flat registration. I heard since it is a flat and not a land I do not need to even give Power of Attorney and instead all the registration docs can be just sent to me to USA and then I can send it back with my signatures. Please advise if I am correct
Latest Answer: HI Jubeen, Being an NRI, you can have the entire deal executed and the property registered on your behalf by anyone you choose. Make sure you choose a reliable, close person because you are trusting that person with a lot. He or she could be a friend, family member, colleague. All you need to give that chosen person is a Power of Attorney to transact on your behalf.

Q: i am scared that as power of attorney is not a legal document for transfer of property and investing money in the floor can be risky but with my budget i can get a house in this locality only.

Latest Answer: Yes it is necessary. It is mandatory to get endorsed any document from their respective Indian Embassy. If you send the POA,kindly note that it requires to be registered at Registration Office in India of your father's residence with a fee of Rs 200/ or so and he can use it as and when required and please do not go for General Power Of Attorney but the specific one for the specific transaction.

Latest Answer: You can obviously transfer the power of attorney to your husband. He has to be a citizen of India. You can register the power of attorney in your area's registrar's office.
