Penality from builder for Amrapali Sapphire Phase 2
Q: Hi, myself and 5-6 other friends of mine own the flats in amrapali sapphire phase 2...as you know, the possession is getting delayed for this and hence starting from Jan 2013 onwards, we are eligible to get the penality from builder. This information is posted on this form to get the details of buyers in amrapali sapphire phase 2 so that we all can form a group and take the penality discussion forward with builder.

Hi all, I am having flat in R-Block... After so many of delay when I met today with ampralli project manager, they are refusing to pay the penalty as stated in our agreement...still promising to deliver by Feb '17...after so many fake commitments.. please suggest what we can do expedite 9811700732

Hi, i am Prashant Chauhan, my contact no. is 8588831453 i dont know if this group is still active, i have a flat in tower Q and just received Possession letter few days back, however when i checked the site, tower is not at all ready for possession, builder has not got completion certificate from NOIDA authority, i am planning to go to consumer forum as builder is not paying penalty too,

Yes the builder is not agreeing to the penalty clause. I would also like to share the details of my experience of living in X Tower. We moved in on 01 Dec 2014. The experience is horrific. Most of the utilities are nor functional. Only one lift has been installed which apart from the residents,is also used for ferrying construction material. Most of the time lift is non functional. There have been incidents of people getting stuck in lift for hours due to lack of proper power back up. Quality of construction is very very poor. Amrapali staff at Phase II who are responsible for upkeep and maintenance are not bothered. We have asked for completion certificate from the builder but its not been provided yet. In nutshell, the residential complex is not fit for occupation as on date. BUilder has to provide basic amenities before offering possession.

Hi, I have a flat in x tower , and now the builder send us the final demand cum possession letter few days back and when i personally went and had a meeting with amarpali officials they are not ready to pay any penalty and asking me to pay the final 5% asap and if i delayed in paying that they will fetch interest on that, dont know what to do???
Hi, My suggestion to you that check the registration paper and see whether there is a clause of compensation on delay of the project. If yes, then consult a legal expert and send the builder a notice of compensation.
Hi Mr Mayank, I do agree with Mr Prasad, they can't do anything like this. As per payment plan they have to go. If you will check you sale deed, & discuss with them by showing the papers that as per plan you have paid . and now the project is delayed . So at the offer of possession buyer will pay rest of the amount.

HI, Both under the Specific Relief Act and under the consumer protection Act you can file cases under against the Builder, Inordinate delay in delivery of the possession is deficiency of service under both the acts which award compensation for the delay and as well as the damages caused by the same to the consumer.
Hi vikas & fellow owners I too have booked a flat in z tower of amarpali sapphire phase 2 and builder has now issued a demend letter for final / remaining payment without any adjustment of penalty amount for delayed completion . sure Mr vikas, all the builders have a penalty clause where in they do pay compensation if the project is delayed but the fact is that often the amount is quit e less....

hi i have a flat in H tower...the penalty is of 22 months but amrapali is ready to give only 16 months citing force majoruere as the reason.As far as i understand it is the act of god/calamity by which he can delay using this clause but the reps told me it is due to farmers strike.Anybody also facing the same????

I appreciate your initiative..... our flat is in tower T... the builder has denied to give monthly pay outs of penalty... however they saying to adjust it in final payment...this is not good....we are ready to cooperate you...we should disscuss it further and take actions acc.
