Hi, my name is Naveen, recently i booked an apartment in D Block of Pride Springfields.. After scrutinizing the legal Documents, my advocate has asked a clarification, "why the spouses & children of Land owners are not made a parties in the Joint Development Agreement.." For this the builder is telling that the land owners comes under "Hindu undivided Family" for which grand children consent is not required. But my advocate is not convinced by this answer. So I'm in dilemma now.. Plz let me know whether any one of u had taken legal opinion on this & what was the out come..

There is no clarity about the First owner's right over the property. If its an Assignment, then an Assignment Agreement with the permission of the Builder is required. Approach a Lawyer with relevant documents and take immediate legal action
