Q: Hello, I have also done my research regarding this. I was looking into buying an apartment at Raja Aristos. The builders are misled with the factual situation. In my understanding the release and the confirmation deed were executed by the GPA holder of the sister of the landowner after nearly 7 years of the partition that had taken place and that too without giving her the deserved legal share. The dispute is the regarding the execution of the documents itself and the partition that had taken place. My lawyer on scrutiny of the papers advised me that it appears that the partition itself is in question and contemplation. (continued in the next post due to the 1000 character limit)
My lawyer on further scrutiny of the title suggested me the JDA (joint development agreement) between the land owner and developer was executed based on the partition document and other documents. He has advised me to think twice about purchasing the same since we do not know whether the partition is legal and the JDA would stand on, and in case it is illegal then the title under which I purchase would be defective in law. I understand that any property under litigation would not transfer proper legal title or rightful ownership to the purchaser. Therefore my legal counsel has advised me not to risk investing in the same. Hence I'm thinking twice about it and voicing my opinion here in this forum.
