Q: The Lake District Project is delayed beyond comprehension. We have booked a 2BHK Flat in Bldg C4 in Jan 2011 which is a part of the Phase1. As per the agreement the Apt should have been handed over by Dec 2012 considering all the grace periods of more than 6 months. The building has only reached 6th floor out of the 12. How many are such agreived parties? Can we join together and issue a notice to the builder?
I received a call from PRA sales office, indicating that the OC has been acquired for Phase 1 and that the final delivery will be done in the next 15 to 20 days. I have a flat in A2, did anybody else receive such a call and has anyone in this group taken possession of their flats. Just checking, though I plan to make a visit to the Site in the next few days.

No Dinesh, I did not visit the site. But they called me today, indicating that the OC has been acquired.I am planning to go there by some time in the new year, once done, I will be able to provide some update.
Received an email from PRA, with the occupation certificate attached and the final demand letter. Anybody has any other information regarding the same. The email says the OC has been acquired for Buildings A1, A2, C1 & C2.

I bought a flat in c4 building in jan 2011 and also did the registration at same time. As per the clause pocession should be given in 18 months from the date of start of construction, considering delay due to other reasons for 6 months, possision should be given by 1st quarter of 2013, its end of 2015 and still no signs of possession, latest update form them is they will give possesion by 1st quarter of 2016. Any c4 building buyers here ?
Did any one get a supplementary agreement from PRA or a call stating the work for phase 2 will start from 2nd quarter onward . And the structure which was 12 floors has now been approved for 15 floors .
HI. I too am an owner of a house in Lake District in Kondhwa and am yet to get possession of my house in A3 which has been delayed by 3 years. Please advise if there is a group of owners interacting on a similar basis. Hi Vishal, check your sale deed or agreement paper for any cause related to delay in possession, if there is any written proof, you can claim your delayed interest from builders.
nowadays builder is very smart they don't put that clause in the sale deed and agreement, we should file a case against them because the clause of delay mentioned or not, but they are bound to pay interest if delay is done because of reasons other than government.

Better, visit the developer's office and make make a discussion on the issues. Check, whether they have got occupancy certificate or not. If yes, then take the possession of the flat first. Don' t sign any paper without checking it by a good property expert or lawyer.

It recently came to know me that the construction work is the progress is faster than last few months and construction of club house and swimming pool is in full swing, few owners are staying in their flats. Better, visit the site see the status with your naked eyes. Don't just go by " heard and found".
As i can see that project is delayed by almost 2 years in that case you should take the advice of a legal expert or you can file a case in consumer forum for delay in possession. You can also take the help of a legal adviser and ask him that what is the possible way to get our possession and the compensation amount as well.
Hi Shamita, Now only option to builder is to pay compensation to flat owners and give them keys happily to stand in Market. They might giving false date to Media also. Middle management and legal team of company making fool to owners of this company. Legal team earning lot of money from the builder by telling him wrong steps like filling writ petition. They know the end result.
Yes Shweta, Fighting for justice and own rights is more important than Compensation. People should teach similar lessons to builders on regular basis. This result is best example of unity of buyers, faith in consumer court, team work to teach a lesson to builder.
I went to the site on August 23. The A-2 looks complete from outside but the elevators are not commissioned/working so we could not climb 12 floors to see our flat form inside. So we do not know if all interior works as promised by them is completed or not. On my part every week I religiously keep writing to PRA and the usual reply is they are do the final touch for handover.
I quite honestly do not know how serious they are in handing over this already delayed project. Among the owners also I see a lot if reluctance in going the legal way ....with just one or two members suggesting it. Rest everyone is blissfully silent hoping to get a "peaceful" possession soon.

Hi all, I had been in march and a sales guy in the office told me that from April to sep'2014, they will finish the phase-I handover and after that excavation for Phase-II and indus world school will start. The buildings looked almost complete and road and other stuff was goin on...also they have to look at the water connection and so on.
Well Deepti, I guess delays in project is new trend...I stay at NIBM and there this project called Latitude by Ahura Builders..they have completed 03 buildings and possession date was June'13...still no sign of handover for next 4-5 months.

Every time I call them, there's a new excuse for the delay and if u ask for penalty payment they say you need to wait till possession to get the pittance of 9%. I had booked a flat in A2 in May 2010 and waiting since 2011 to take a handover. Its harassment at its best and would need help and understanding how others are dealing with this.
I also recently spoke to them and they said that the possession will be given in 45 days, this is after I was communicated on email that they will hand over the apartment for fit-out by May 15. When asked if that is the real possession they mentioned that the complete possession with all the permissions will be handed over after 6 months, and going by how it is now, it doesn't look like the possession will be given in 2014. What is the legal course, I think there are enough members here to form a group and take combined action.
I agree Agnelo, I have a trail mail of correspondences with all the senior management team at PRA and they repeatedly been ONLY giving excuses. I am not bothered if the issue is related to contract labour shortage or water supply. There is a contractual obligation to handover the flat and there is a penalty for the delay. However going by the past records I have my serious dobts if they ever will stick to these fancy deadlines.

Can anyone suggest some good lawyers or consumer forum where I can lodge a formal complaint against the PRA guys ? This has been ridiculously delayed over 2 years now. All I keep getting email response is further delays. As per agreement in the event that there is a delay in possession beyond the committed timeline the developer is liable to compensate @9% for the amounts until then received. I have got the next demand letter to pay the 12th slab payment. I have already paid 85% of the project cost. I am in a dilemma now, should I pay or not as the builders say that if you don't pay before due date, then at the time of possession you won't get the delay fees. Can they do that? What are other owners here doing? Have you stopped paying the amount towards the flat?
i had recently visited their site office, i was informed that the flats will be ready for fit-out's by mid may ... but the occupancy certificates wil be availble till August :(
on site people say they can hand over the flats for furniture fittings by may technically unless there is occupancy certificate they can not officially hand over the flats

Hi Rohit, Is there anyone at the management level at PRA where we can escalate the matter & get the real dates of possession? I too visited the site a week ago & I was also informed that they are planning to give possession of Phase-I from April 2014. Also some of the interior work in the flats is pending viz. Plumbing, tiling in master tiling. etc. Lets see if we can get a positive response from them.

Hi Vatsa, No, it is not correct. You might heard wrong. They are going to start the construction work of PH-2, and will provide possession of these 5 towers in March'2016.
Are you sure that they will provide possession of the PH-1 property till April'2014? What is the current price they are quoting for both PH-1/2? what is the total nos of units in Ph-2?
Well Vatsa, It is very difficult to say that they will give possession of PH-1 on time or not. Because the construction work is not in my hand it depend upon the developer. But i ask again & again about the possession date and remind him about the previous delay but their reply was same.
The current price they are quoting is 3350/sq.ft on 7th floor but it will increase as you come downward for PH-2 only because the PH-1 has been sold out. they are going to increase the price soon upto Rs250/sq.ft from next month.
yesterday I had been to the sight and at last i saw some movement, work was in progress. The sales rep updated me saying there are app 120 workers on work and by next week it would swell to 200 nos while the building is done by Vascon road work was also in progress and it was given to some other contractor
As per an email form the sales office, the construction will restart on 1st Feb. The contractor will handout the flats for Fit-out in April. Usually Fit-outs take about 60-90 day, by that calculation the flats may become available for possession by August 2014. Also it doesn't seem like there is anything written in the agreement about compensation

One of the agent took me to that project and told me to invest.. but after reading all the reviews I don't think I will give a second thought. I would suggest everyone to go to the project on a weekend as many new customers come to see the project and should also tell them about it as once the sales team gets impacted then builder will start speaking and compensating
Incidentally if you all recollect, there is a interest pay clause if the possession date is delayed by 18 months from the date mentioned in agreement. What is the status of the same, any comments from builder to any one here, please?
