CMDA completion certificate

Q: Please advice whether it is advisable to buy a flat in a Stilt+4 project that is complete.Only hitch is that builder has secured power connection through Legal route.Builder says CMDA completion certificate will not come.will it be a safe investment?KINDLY ADVICE

I am not a legal expert. But just got my building completed last year. Completion certificate is required for getting power and water connections, as well as assessment by Chennai corporation. I am not sure how the power connection has already been obtained.

Home loans by banks are usually decided when the plot is verified as legal, without any encumberances, and the building plan is approved. No one can wait till completion to buy / sell the apartment.

The issue is not as much with loans, as it is with the legality of the property itself. Long story short, it is not a good idea to buy a flat without the CMDA completion certificate. For that matter there are builders who do unauthorized things after the certificate is obtained (E.g. extra balconies, service areas, converting carparks to rooms or vice versa, converting open terraces into rooms etc.). We need to be careful about all that.

Today's TOI carries a news item that Madras High court has pronounced that EB connection can not be given without CMDA completion certificate.
If that be so,what will happen to those projects where the Builder got EB connection through single judge court order?

If the builder is not giving completion certificate then I think you may face problems in getting home loans. It is better to ask the builder which are the banks providing loan for this project and also take help from legal expert to cross check all the legal documents that are available with the builder.

Here the matter is not concerning legal documents.Further , the Banks now a days are more concerned about achieving targets and hence give approval once they do initial check that includes EC.
They do not worry about CMDA matters
I request a specific guidance as to whether builder can avoid CMDA completion certificate.
