Q: I wish to know whether E voting is feasible for election in big residential complexes. This is because very high percentage of owners reside out side the complex. At present these owners use proxy for voting. My question is whether any apartment complex uses e voting method during election to the association.


Q: Please clarify whether Tamil Nadu apartment owners act is a template and contents can be modified to suit apartment complex or is the provision binding on ALL apartment complexes? Can OWNER's SPOUSE or PARENT contest election to office bearers?

Latest Answer: Thank you. In our Association Bye laws, there is no provision for Associare member category. Can this be incorporated and approved in EGM and then pave way for voting or contesting election by spouse or parent ? Please confirm. Thanks

Q: Can any one tell me whether Licence from Department of Fire service is needed for 10 year old Multi storey residential projects. If yes, what is the validity of such a licence? Is it to be renewed every year?

Q: We do not have Owner's Association in our residential complex. Builder is managing the maintenance and security aspects. He is charging service tax.How do we find out whether it is paid to the Government by him?

Q: Please advice whether it is advisable to buy a flat in a Stilt+4 project that is complete.Only hitch is that builder has secured power connection through Legal route.Builder says CMDA completion certificate will not come.will it be a safe investment?KINDLY ADVICE

Latest Answer: I am not a legal expert. But just got my building completed last year. Completion certificate is required for getting power and water connections, as well as assessment by Chennai corporation. I am not sure how the power connection has already been obtained. Home loans by banks are usually decided when the plot is verified as legal, without any encumberances, and the building plan is approved. No one can wait till completion to buy / sell the apartment. The issue is not as much with loans, as it is with the legality of the property itself. Long story short, it is not a good idea to buy a flat without the CMDA completion certificate. For that matter there are builders who do unauthorized things after the certificate is obtained (E.g. extra balconies, service areas, converting carparks to rooms or vice versa, converting open terraces into rooms etc.). We need to be careful about all that.

Q: Kindly let me know if any 3 bhk flats of about 1700sqft is available for sale in c v Raman nagar . It can be a second hand flat(less than 5 years old) or under construction. It MUST be a BDA,BBMP approved flat.
