Q: I have booked a commercial property and got MoU from builder in which first leasing guaranty is mentioned. After few months builder sent BBA for signing in which leasing guaranty is omitted. So should I go for signed BBA or MoU is fine. What I understand from BBA and MoU is, with BBA one can legally enforce this document in court where as with MoU, one can not legally enforce. Please revert.
Hi Mr Kumar, you can ask the builder to mention the leasing guaranty and after that sign the agreement.In case of any future delay by builder OR project is stalled OR builder is not doing what was said to buyer in while in booking, Registered BBA is the only one legal tool which you can easily use against builder.
