CLU is nothing just a permission from the authority to change of land use for agriculture, industrial, residential, institutional, farmhouse, and recreational facilities. Whereas, impact fee is charged for conversion of land on the same.

Q: I have a flat in Shipra Sun City in Ghaziabad that is jointly registered in my mothers and my name. My mother passed away last year and my brother and sister have agreed to give up their share of inheritance in my favor. I would like to know how I can get this property registered in my name? Is gift deed or relinquishment deed a way to go or is there some other process? What are the monetary implications of going with the gift or relinquishment deeds? Thank you.

Latest Answer: My mother did not leave any will but when alive had expressed that it be passed on to me. My siblings are respecting that wish. Gift deed at 8% stamp duty will entail a lot of money. Is relinquishment deed a cheaper and at the same time a foolproof way? This is a leasehold property.

Latest Answer: Hi Manu, There is only one way if your father agree to execute gift deed of your parts of share in your favor. It has to be stamped and duly registered.

Q: Sir,
I have purchased plot for build own house from Defence Mega City Lal Kuwan by taking personal loan from HDFC bank. But my plot has been taken over by another builder Dream City. I have contacted so may times in Defence mega City office and also met Mr. SK SINGH but nobody giving any response. I have registry paper and mutation paper. Please give suggestion , I and my full families are in mental tension.
Latest Answer: Sir, I have payment receipt copy of the payment made to the builder Himalyan Infracon Ltd. I have also have registry paper of Dadri registry office and mutation paper. I have contacted so many times in Himalayan Infracon office but Director of Himalyan is not giving any proper response.

Q: No development has taken, It is only wheat crops and mud dunes. The builder has now started raising demand, The project is also not approved from any bank, only some low lying NBFC are funding the project. what respite can i have...any more customers of Wave Royal Castle is facing the same issue.

Q: I have an old Builder flat in Indirapuram, ghaziabad. The registered area is 50 Sq. Mtr but, the covered area is around 65 Sq. Mtr.
I would like to rectify the same. Just wanted to enquire, how much will it cost? Is there any panelty for the same? If yes, how much?
Latest Answer: Hi Rahul, Do you have any document, stating that covered area is 65sq-mt. If you have, then take it to the nearest registration office. Ask about rectifying the covered area from 50 sq-mt to 65 sq-mt. Yeah, I think you have to pay some penalty also foe this extra 15 sq-mt.

Q: I have booked a flat in Raj Nagar Extn, Ghaziabad. I have the full amount of the flat to the builder. Now builder is saying that only after registration of property, flat can be handed over to me. I know that one has to register the property but it doesn't have to be before possession.
Latest Answer: Hi Sameer, Always remember, property registration is very much necessary. It is final complete agreement between two parties. Once registration of property is completed, then you are the legal owner of that property. Unregistered owners are illegal in front of law. Property registration is very much compulsory to prevent cheating & future problems.
