ambiguity in number of floors/floor number

Q: Hi,
i came across a resale property which had approval from CMC.the said apartment has one parking lot at ground fllor(not at basement/underground)and additional 4 floors.i heard in 2004(when the building was built) the CMC used to give approval for only 3 floors. since the flat i am planing to buy is on the 4th floor i am confused.is the floor above the parking fllor is considered a ground floor?can we consider a project with a parking at grond level and four floors above it to be a G+3 apartment?

From the description of the problem it seems that the developer is most probably not building as per the permitted plans.Please aslo check if any housing finance institutions are providing loans for the project. If yes in all probabilities they would have scrutinised all the relevant documents of the building in question. These HFIs don’t provide loan if the project is under any kind of illegality.

To have a better clarity on the issue, we suggest you should take a safer route and hire a real estate lawyer. The plans that are sanctioned in the local authority should be verified. You should also get it checked that what is the permitted use for the apartment floor that you want to buy.
