Rules of converting Agriculture Land into Non-agriculture Land

Q: Hi,
Good news for those who has agriculture land and wanted to be convert into non-agriculture land. The move that could help in boosting the development in Maharashtra to help in conversion of agricultural lands in cities and townships into no agriculture land has been simplified in a state cabinet meeting.

Last message on this discussion was in 2014 so is there any changes to convert agricultural land in NA plots..?
And also can we do the same when number of owners are more..?(4-8 number)

Hi Shreyas,
You can convert agricultural land into residential or industrial land by paying a fee known as conversion fee. You can get a change of land use after obtaining all the necessary approval from the local authorities. You have to apply to the commissioner of the land revenue department, explaining the purpose of conversion. Along with the application, you need to attach certain documents such as ID proof, mutation letter, original sale deed or gift partition deed, latest tax paid receipt and certified survey map. There is a fee to get the land converted, depending on the nature of the property and its location.

Yes, i agree with Abhishek. Apart from that, the details of extent of land, names of the present and previous owners, kind of soil and crops, mortgages etc also need to be provided. Certified copies of these documents can be obtained from the revenue office or the Tahsildar. All outstanding dues should be paid in full and copies of payment proof should be attached.

I am having land in kakinada corporation(andhra pradesh), we want to use for N.A Purposes, but conversion fee 10% of base price in andhra pradesh. which we cant afford. any alternative. please suggest.

We have 18 acres of agricultural land at Phaltan. We want to convert it into NA for residential complex.

Hello,
According to the new order, the premium will be charged according to the demand for change in land use. For conversion of agricultural land to residential land, the premium would be 50% of the total value of land as per ready reckoner rates. For agricultural land to commercial land, the premium would be 75% while for semi-public land to residential land, it will be 20%. For residential to industrial use, the premium would be 20% while for forest to agricultural, it would be 40%.

It really sound good. The move now means that those planning to set up an industry can approach a tehsildar and start work after getting the permission. This is a huge relief for entrepreneurs in the state as earlier this involved taking anywhere between 22 and 32 permissions (NOCs) from different authorities before one could start work.

Currently, The Maharashtra Government has done away with the need to obtain permissions for changing the use of land to 'non-agricultural' category for land covered under the Development Plans (DPs). They simplified the procedure to convert farmland into non- agricultural (NA) land for plots covered under Development Plans (DPs) in urban areas. The GR has made it mandatory for revenue officials to furnish details of classification of land (agricultural or non-agricultural) within 30 days of receiving an application.

Right Pradyuman. And plots falling under a particular category won't require status change to NA. In certain cases, obtaining a No Objection Certificate (NOC) from the District Collector within 30 days by paying fees prescribed under rules will obliterate the need to transfer the land to NA category.

According to new law no land owners will have to seek the permission of the municipal body for their non-agricultural plans. Once the municipal corporation or municipal council gives approval, the land owner just needs to intimate the collector in 30 days. No permission from the collector is required. Revenue officials will then recover a one-time land conversion tax and a non-agriculture cess.

In rural areas, where there are no municipal corporations or councils, revenue officials will be asked to create a databank of conversion applications, so that decisions can be made quickly.

But remember this process will apply to those who are direct owners of the land. For those who have leased land from the government, the collector's permission is still required

Hi everybody,
The new law will benefit land owners in the development plan areas of major municipal councils like Nagpur, Pune, Pimpri Chichwad, Nashik, the cluster of municipal councils in Mumbai city, and other major cities in the state which have declared development plans. Nagpur city, for instance, has declared a development plan for a 3780 sq km area named "Metro Region", comprising around a 3rd of Nagpur district.

Hello Shalini,
Under the new rules, getting municipal approval for the development plans will be considered sufficient for land be converted from agricultural to non-agricultural purpose in urban areas. Earlier the process required the land owner or developer to get certificates from each and every urban administration-related department in the said municipality, and finally the permission of the collector.

My land is not under PMC and comes under residential zoning will be NA, and the process for converting such agri lands in residential zones to NA is going to be easy.

It is not the matter of PMC, i guess any Agriculture land will be able to make na with out approval.. but they have to plan the pass from muncipal corporation...i dont knw something is missing from the news which is confusing.

The good part here would be the builder-politician lobby for conversion of NA will be gone to large extent. This is also good as delays due to NA approvals would be reduced. Good for builders & buyers both.

It will benefit those areas that falls under the municipal corporations and councils in Mumbai, Thane, Navi Mumbai, Kalyan-Dombivli, Ulhasnagar, Vasai-Virar, Nalasopara, Ambernath, Kulgaon-Badlapur, Panvel, Alibaug, among others.

Now, the owners of these plots will not r have to take earlier permission of the collector for the conversion if the plots are listed in the region's development plan for residential townships or industrial units.

The leaseholder will have to offer a certain share of the profitable deal on the land to the government.
