does buildings in Bavdhan budruk can be occupied without occupancy certificate ?
Q: I have booked a flat in IRIS BAVDHAN in Pune by Skyi builder . He has not received Occupancy certificate . He has got only partial completion certificate. The builder is saying as its in Bavdhan budruk, it does not come under PMC and comes under regional planning rules. So it does not requires occupancy certificate and partial completion certificate is enough to occupy the flat after possession. As far as I understand without occupancy certificate I can not stay in the flat and without completion certificate builder cannot demand for possession. Will property tax be thrice if i do not have occupancy certificate ? Is the construction might having some legal problems or disputes ? I will like to have everything legally clean and clear before taking possession and occupying the flat. Kindly advice.
Hi, The area was supposed to be included in the PMC limits not under regional planning rules. So, check the project approval and related document before investment. There is no legal issue with the project and the flat is ready for possession. You can go for this project.
HI, Few Years back PMC made it possible for individual flat owners to get the occupation certificate themselves if the builder had not procured it. PMC has reduced the no. of NOCs required by the buyers to get OC than compared to what the builders would have need to get. Once the buyers get the NOC from the said depts, fire & lift & submit is alongwith other docs to the PMC, the said project will get OC. Not doing this will result in fines for the buyers.
