Q: What will be the GST on a ready-to-move-in commercial shop from a builder wherein he is still waiting to get the Occupancy Certificate? Can the builder get the input benefit from the government on a deal?
Latest Answer: GST is applicable on properties that have not yet received the Completion or Occupancy Certificate. Ready-to-move apartments will have no GST but the developer will only get input credits on construction costs. Developers will collect and pay GST on the cost of the project.

Q: Have they received an OC for all their 31 floors in each tower?
should one make an investment on the 30th floor or are they facing legal issues for illegal construction?
Latest Answer: Hello Ashish, There is two litigation going on with this project. First in the Bombay High Court (2014) and second in National Green Tribunal, Pune (2016). I will suggest you to stay away with such project. Thanks

Q: Hi All, I have booked flat in officer city 1 (Ready to move) and as per builder we can shift in the flat after full payment and he will give us possession letter on same day. Can anybody please suggest me that any builder can shift without OC and CC approval.
Latest Answer: Builder has no right to delivered physical possession without getting the OC. However, some builders only to save the penalty amount offer the possession, which totally against the law, buyer can lodge the complaint against them. Regards Sunil Tiwari, Advocate 9717161215

Its been more than year since this project got completed, but does it not have OC until now.
Latest Answer: Hi Pooja, OC is an essential legal document that has to be obtained by the builder once the construction is complete. This ensures that the building has been constructed in a completely legal way adhering to the approved plan. Maybe there is some issue for which the builder has not got the OC yet.

Q: I am about to get possession of my flat from AFNHB Airforce Naval Housing Board. Builder is telling me to register the property prior to giving possession.
Is this legally permitted
Latest Answer: In India, builders cannot compel buyers to register properties before granting possession. As per the Real Estate (Regulation and Development) Act, 2016, builders must obtain occupancy certificates before handing over possession.

Latest Answer: Hi Abdeali!! Don't purchase any flat in such projects. The banks and financial institutions are most unwilling to give loan in respect of properties which do not have OC. Besides, no wise buyer will agree to purchase such property.
