Complaint aganist builder - Niho Construction Limited
Q: I booked an apartment (D-302) in Marvel, Niho Scottish Garden, Indirapuram (UP) in April 2008. At the time of booking, I was told that the apartment will be ready for possession by August 2009. The formal agreement, which we signed, mentions that the apartment will be ready for possession by October 2009. Based on that I paid 95% of the apartment cost in advance. For that I also took home loan from Bank for which I am paying very high interest rate.
Now for past so many years I am following up with you but unfortunately the builder is not giving any satisfactory answer. They never informed about the delay in project, change in management, even change in the plan (initially they told two towers of 5 floors each, which they now have changed to one tower of 14 floors and may change it again) etc. There is no written or verbal communication by the company about the delay or any changes. Every time I called them they come up with a new story or excuse. Moreover their staff is changing every time so you deal with new person all the time.
So far there is no construction at the site. I am circumspect about this builder. Below is their contact details

I know quite a few other members who also paid good amount of money to this builder. They are also helpless like me. We are thinking of going to the court but unsure of lengthy legal processing. Moreover, builders are known in twisting the contractual clauses to their favor.
The builder has refused to return the amount despite requests from me. Amount given by me has been dishonestly misappropriated and the all the accused have committed criminal breach of trust and cheated the complainant. Respectfully on the order of court an FIR bearing no 0291/2015 is lodged at P.S. Hauz Khas Delhi on 16 Mar 2015.

Hi, As per my knowledge, you should check with builder regarding the construction plan . Have you checked the plan approvals & other necessary documents before purchasing an apartment ? You should discuss with builder about compensation for delaying project possession. As per your sale deed you should get delay compensation by builder. If builder is not providing it ,then you go to consumer court.
