Rental apartment problems

Q: What to do after renting an apartment If you find out that toilet, geyser are not working/malfuctioning and there are several other problems. Also, apartment was not clean and owner said, she spent Rs. 2000.00 to clean the apartment. But apartment is not clean the bathrooms and kitchen are dirty and there are cockroaches even in the bedroom.Owner had left some of her things in the apartment and broker said he will have it removed but so far he has not done so. Broker is not responding about the repair work either.. What is my recourse? Before renting an apartment I had asked the owner whether she can install a fan in the kitchen? she had agreed to it but later on said she would not. I have signed 6 months locking period in the agreement. I am an NRI trying to resettle in Mumbai. What are tenants Rights in State of Maharashtra? Please reply this is URGENT. Thanks.

HI Praveen,
At the same time if it is not in your rental agreement or lease, your landlord is required to keep your building and unit in a habitable condition. This means that your landlord must make sure that the building is structurally sound, provide hot and cold water, ensure that the roof is not leaking, and keep the plumbing, electrical and heating systems all in safe operating condition.

Hi Abhijit,
There are only a few occasions when minor repairs may be required to be fixed. If the terms of your lease agreement state that the landlord will fix any of the problems you are having, then the landlord is under a legal duty to do so.

Tips to get your Landlord to make Minor Repairs:- 1) Put it in writing, 2) Mediation, 3) Report your landlord and no last but the least bring a law suit against your landlord.

Hi,
Renting an apartment can be an easy and pleasant experience or a living hell, and both outcomes generally depend on whether or not you have a good landlord. Rent is not necessarily negotiable, but many landlords are willing to compromise on price.

If anything is ever unclear, make sure it's clarified in writing and becomes part of your lease. If something in the lease seems wrong, ask for it to be amended.
