Latest Answer: HI Praveen,
At the same time if it is not in your rental agreement or lease, your landlord is required to keep your building and unit in a habitable condition. This means that your landlord must make sure that the building is structurally sound, provide hot and cold water, ensure that the roof is not leaking, and keep the plumbing, electrical and heating systems all in safe operating condition.
Q:
Mumbai apartment housing society Maintenance office asks residents to submit photos for ID cards. ID card was to be issued when everybody's information was collected. Several months later, when asked to the management officer about the ID card he said, it will be issued within 15-20 days. Eight months have passed and now they are saying they have lost my photo and asked to submit the new one. Apart from this, there is lot of mismanagement going on in this reputable housing society, so I refused to give another photo and asked them to find the lost photo. What action should be taken against this careless society?

Latest Answer: Hi,
City Municipal Corporation issue Occupancy Certificate, after ensuring that all compliance of local law is done.
1) Without occupancy certificate, it is difficult to get the water and sanitary connection.
2) Financial institutions insist on Occupancy Certificate for sanctioning loan.
3) People who have invested their hard earned money in such building where no Occupancy Certificate has been issued. They prefer to occupy the flats without power, water and sewerage in fear of loosing the property & their hard earned money.
Laws are different in different states & cities. Wherever any construction is in violation of the sanctioned plan, the commissioner consider that the violation are within 5% of the set back to be provided around the building, plot coverage, floor area ratio and height of the building and he may regularize such violation after recording detailed reason for the same.

Q:
In Mumbai housing society, where builder's sales person helps owner to rent out his/her apartment can charge tax on the commission they get from the prospective tenant? Is it legal?
Latest Answer: Hello, Praveen Modi
Thanks for replying to my question. There is a well-known builder in Mumbai area and they have quite a few apartment buildings around Mumbai. As I am looking for rental property, I talked to one of their sales office who is helping some of the owners in renting out their newly purchased flats to prospective tenants. They told me that they charge commission plus tax of 12. 36% (or so) on the commission amount that they get from the prospective tenants. If they are doing this, is it illegal? Should this be notified to some Government authority?
I was wondering are you quite familiar with real estate issues? The reason I asked because I have another question in which I need some guidance and would like to post that question here.
