Already Registered, So should I be now charged extra?

Q: After registration of my agreement of an under construction Residential project in 2013, can the builder now charge for flower beds, service area and dry balcony? Besides they are threatening of not giving possession if the amount is not paid, though I have already paid the amount of saleable area.

As per new DC Regulation, any area near/inside an apartment, not included in the carpet & which can be enclosed inside, for e.g: flower bed area, dry area, passage etc has to be taken into consideration while submitting approval plans, and these areas would be included in FSI. A builder can buy maximum of 35% area(in case of residential development) as fungible FSI by paying the ready reckoner rate of the region. Do note that this is over and above the total FSI consideration.

any area inside the apartment, and adjoining it can be considered to be the carpet area of the apartment, this would not include the common area, but will include internal areas such balconies, dry area, etc & passage area to the apartment.

The dimensions and specifications of the entire building, its compound and all common amenities must be mentioned, because that is what you are paying for and not just your flat only. The agreement must mention specific details of each and every amenities promised.

Hi,
It is important to have your agreement scrutinized by a lawyer, so that the builder does not include clauses that are to his advantage and your disadvantage. If it contains any such unacceptable clauses, please suitably modified before you sign the agreement . Don't make any payments unless this is done.

It should mention the actual measurable dimensions of the flat i.e Carpet area, excluding non-FSI elements suh as flower beds and dry balcony.
