Q: Hi, i wanted to invest in a project in Kochi, and heard about some changes being made to the land acquisition act. How will that affect the real estate market in Kochi?
If the acquisition is for a private project, consent from at least 80% landowners is required. The NDA government has amended the LA Act exempting this clause. While there might be some political motivations behind the whole thing, the eventual benefit, cannot be put aside.
Projects like the widening of national highways can also be included in rural infrastructure. The new LA Act introduced by the UPA Government in January 2014 has a clause that makes consent from at least 70% landowners mandatory if the acquisition is for a government project.
See, the way i see it, the reforms introduced in the LA act, will definitely help these new projects mentioned in some of the comments below. Also while some opposition is expected, i think we need to understand the fact that every thing has it's pros and cons.

Yeah, even i agree with the environmentalists. Though the Union government has mentioned five purposes for which land will be exempted from SIA, any project can be given the label of social infrastructure or rural infrastructure project.
I heard somewhere that in the case of electronic park, the plan was to acquire around 250 acres. Later, authorities decided to reduce the project to around 100 acres to exclude paddy fields. With the new reforms in LA act, things are looking up.

Yes, If the project is being done under PPP, the ownership of land must continue to be with the government to avail all relaxations. As per the revised Act, multicrop irrigated land can also be acquired for these purposes.
Let me add to that, as per proposed amendments, the mandatory "consent" clause and SIA will not be applicable if the land is acquired for five purposes such as national security, defence, rural infrastructure, including electrification, industrial corridors and constructing social infrastructure following the public-private-partnership (PPP) model.
Well, the main proposal to remove the clause which makes social impact assessment (SIA) mandatory prior to the implementation of mega projects will be helpful for these projects caught in environmental issues. That's the only change i remember
