Q: i m planning to buy a resale flat but the seller doesnyt have oc. he even doesnt have khata in his name. the khata is in the name of the builder. should i buy this flat? what are the risks associated. pls advise.
Occupancy certificate (OC) is a legal prerequisite for a buyer, before heading for an apartment. Furthermore, having an OC is the license for a buyer to apply for Khata.
For every residential complex bigger than five units, getting hold of an occupancy certificate is a sine qua non before moving into a flat or house. As per market news, buildings which will be built on sites measuring 100 sq meters and a height up to seven meters, it is a mandate to latch onto an occupancy certificate.
It is always advisable to go for an apartment having Occupancy Certificate.. Now-a-days it is mandatory to have a OC without which it can be risky in future.
