Can a member of Apartment owners Assn. approach Registrar of Societies if the E.C. commits monitory irregularities?

Q: The Executive Committee of our Apartment Owners' Assn. is not maintaining several registers for the last 2 years. which are required as per A.P.Societies Registration Act 35 of 2001. The E.C. is not conducting Elections as per the procedure, nor submitting the accounts to the General Body. I suspect misappropriation of communities funds.

Can I approach the Registrar/ sub-Registrar of Societies in the State? How far it will help the community. This is about a Apartment Owners' Welfare Association in Hyderabad

I am a chartered accountant and am an auditor for many housing societies in Hyderabad. I also write a blog called www.hydapt.com on this subject. I will share my perspective. I presume your society is registered with the AP Societies Registration Act 2001. This Act does not provide for any penalties in cases of default. The only recourse available to you is a civil suit in a court. Regards, Satya Sridhar

Hi Vani, The Association is formed by 7 or more owners in the Apartment Complex approaching the Registrar of Societies together and submit an application.

1. Encloses a memorandum with following details: desired name of the Association, aims and objectives of the association, and who in the association will be authorized to correspond with the Registrar of Societies.
2. Encloses the Bye-laws (rules and regulations) of the Association.
3. Encloses the prescribed fee.

Hi Pradeep, What is the common practice followed in monthly maintenance charge if an apartment has different area flats. Is it a common rate or divide as per the Flat area? Is there any rule which association need to follow?

Normally, the maintenance should be based on the per sq ft and not per flat. That is only fair among owner, I think...
