Legal advise required

Q: I intend to buy a 6 years old flat having all papers except Katha
It seems builder has not paid the betterment charges.And banks are not willing to fund with out Katha.
My questions are:
1.Why banks refuse loaning, when all other documents are there including completion certificate.Property tax is being paid regularly.
2.Why Katha is refused for no fault of the flat owners?
3. With out collecting betterment charges how completion certificate was issued?
4. Any legal remedy to get Katha?
Some one pl explain.

If the promoter is not paying the betterment charges than I think you have discuss this with the legal expert or pay the betterment charges yourself and get A Khata

You can get Khata through the Sakala Scheme. The Government introduced this Sakala scheme to bring transparency in administration.

Hi Krishnan, betterment charges is no way related to Completion Certificate. Betterment charges are paid to convert B Khata to A Khata.

A completion certification is an important and mandatory legal document attesting to the fact that a new building has been constructed and completed according to all the safety norms and regulations of the Buildings Act

A khata is essentially an assessment of property, a document maintained by the BBMP (Bruhat Bangalore MahanagaraPalike) that specifies certain details about a piece of land (such as the owners name, property dimensions, built up area and tax details). This document is in fact a legal proof of the ownership of any land. It determines who exactly the property is registered to and who is liable to pay taxes incurred on that property.
Khata serves as an important document while trying to obtain a loan from a bank or a building/trade license.
