Lodha group - worst builder, not returning booking amount

Q: I booked a flat in Codename Epic by paying Rs. 45,000/- as booking amount on 10th October, 2015 who's possession is promised in 2018.
Within hours on the same day I informed them about cancelling my booking as I would not have been able to manage flat cost due to some financial problems and also later on I came to know that site was quite far from Palava phase I.
Marketing guys didn't even bothered to show site before the booking.
Even on informing within hours on the same day, they are not returning my booking amount.
They are not authorised to forfeit my booking amount as I haven't availed of any services by the builder as it was same day cancellation.
Please someone guide me, how can I get my money back?

It is quite normal now a days,peoples were cheated like this kind of traps.one thing You can do is charge a case for deficiency and ask your money as refund.

If you have valid receipt then you can claim from the builder, failing which you can send a Legal Notice that you do not want to purchase the flat and claim you money refund.

Thereafter, if the Builder would not reply to your notice then file a case in District Consumer Forum for deficiency of service and unfair trade practice.

m clearly mentioned that booking amount is refundable in special conditions like
- if loan is not approved by the Bank & any other genuine location issues.
Accordingly refunding my booking amount is completely justifiable looking at location issue which I have.

5) I was repeatedly insisting on a days time for me to take wise decision but your sales team tricked me by saying "they will not be able to provide discount of Rs. 50,000/- (waiver of development charges) on other day and price may go up by next day".

Looking at all the above points its very clear that I was ticked by your skilled sales team into making a hurried booking with improper information.
I deeply feel cheated by Lodha for Rs. 45,000/- just for the matter of 3-4 hours.

I beg you not to cheat me as I have specified all the genuine reasons with valid justifications.
Me myself would not have asked for refund in case if it was the matter of few days or if proper information was provided by your sale

Here is my latest mail to Lodha with no reply:

Dear Glen,

Forfeiting booking amount was acceptable if your sales team would have given me proper details.
But its clearly a case of cheating just to achieve their sales target.

Points to be considered:

1) Your sales team never shown actual site before the booking which should have been shown as this practice is normally followed by every builder today.

2) I saw site location on Google map as "Palava codename epic" which was very close to phase I (please refer attached snap shot).
I was under an impression that this was the actual site location and agreed for booking.
But the actual site is very far from what is shown on Google map.
Your sales team also kept on insisting that site is very close from Phase I.

3) I sent a mail for confirming site location to your sales manager (Ganesh) with Google map snap shot but he never confirmed it.
Please find mail attached for your reference.

Thanks for your valuable suggestions.

The payment was done by debit card swipe. Builder has provided the receipt for the same.

Hi Suresh,
Send a mail to the builder in which it should be mentioned that you are moving to the consumer court for the relief. Take the copy of both send and received mail copy along with while filing in to the consumer court.

In cases where the value of goods and services involved is less than Rs. 20 Lakhs in value, you will have to file the complaint in the District Forum constituted in the specified districts of a State.

In cases where the value of goods and services involved is more than Rs. 20 Lakhs in value but does not exceed Rs 1 crore you will have to file the complaint with the State Commission constituted in the capital cities of the different states.

In cases where the value of goods and services involved is more than 1 crore in value then you can file a complaint with the National Commission which has been constituted only in New Delhi.

Hi Suresh,
It is doubtful whether builder will refund your booking amount so easily. How was payment made? By cash or cheque ? you have receipts for booking?

@Suresh,
If the agreement has not yet been made then the process of purchasing the flat has not commenced. If you have paid the amount by cheque and have receipts of payment you can recover the amount from builder. If builder fails to do so move consumer forum for necessary reliefs.
