Hi Friends!!! A buyer who is the victim of the unfair practices of the builder can approach the following forums for his redressal: 1) He can file a civil suit in a Civil Court ,2) He can file a complaint before the consumer Forum, 3) He can file a complaint before the Competition Commission of India, 4) He can approach Regulatory Forums and , 5) He can file a Criminal Case.
Yes, i agree with saran. Or you can do if you have grievance against builder, send a notice to him in writing. Do not worry if he refuses to accept your notice as only proof of sending is required. Send the notice by registered post or Under Postal certificate. Retain the proof of sending. The proof of sending is valid in the Consumer Court Under Section 28A (3) of the Consumer Protection (Amendment) Act of 2002 and will be considered as the notice has been duly served.
File your complaint in the consumer court in case the builder does not respond to your notice.
Hi Brij, With builders coming under the clause of being a service provider, the process of filing a consumer court complaint against them is the same as with other service providers. To file a complaint, you need to adhere to the following steps: 1) Send a well drafted Legal Notice to the builder stating your reasons of discontent await for a response for the stipulated time from the other party, 2) On no-response, prepare a petition stating facts and evidences with the help of expert legal advice, 3) Approach the Consumer Court and file your petition against the builder.
