How many have got their money refunded from Jaypee? They claim to be refunding in instalments.

Q: Booked in 2009. Tower 56. Been following up regularly but to no avail. Decided to ask for refund in the beginning of his year 2016 as advised by their officials. Post the request, they have stopped all interactions. What is the way out now?

Hi,
I know of 2 other people (3 cases so far) who are in the situation where the tower was never built, and have asked for refund. As S Ghosh said, Jaypee is not responding to our queries. If there are others like S.Ghosh, we should make a group to fight them through legal channels together.

I agree. I have explored various options, and the best solution would be to file a case with District Consumer Forum. However, the outcome of the same is dependent on many factors. The best option would be to file the case jointly instead of singularly. If we could connect with 6-7 people who are in the same situation, it will surely make our case stronger and increase the chances of refund with interest greatly.

Hi,
I am agree with all my friends. First of all you should get the deposit amount in full without any deduction hen only you can even think of the interest portion.
However there is no legal infirmity if you demand the interest on the deposit while refunding it and it can be from the date of deposit till the date of final payment.

Good evening
Issue a notice to refund the booking amount within the given time, if builder still didn't turn up then file a suit for recovery of money. You will have to pay the court fee on the claimed amount.

Yes, i am agree with Awar.....Send the notice by RPAD. It is better if you engage a lawyer, he/she can guide you properly and that notice also shall have a better effect.

Hi,
I think you should hire a lawyer and file a case in consumer forum and ask them to refund your money with interest and compensation for the problem you have faced. Most of the buyers are opting this legal route to get their flat possession or for refund of their money.

Hi,
In my opinion instead of filing a civil suit for recovery of money you can file a consumer case before the District Consumer Forum and get your money back with interest. Your case comes within the purview of Consumer Protection Act. In a civil suit you will have to pay advolerum court fee and it is time taking also. There are so many decided cases of State and National Commission on this subject.
