Q: had not paid the dues since their occupation and had an huge outstanding to take the matter to court. This year the new management has decided to settle the matter out of the court by waiving the interest (6 lakhs) . Can the management committee arbitrarily decide in this manner . Further one of the member in the present committee is also a defaulter (4 lakhs outstanding) How legal is this.

I am agree with Lalit. The managing committee can not make any financial demand without approval of General Body Meeting of the society, except marginal increase in existing expenses payable to Govt. Authorities only. Members should must take immediate action before the managing committee raises demand.

No, it is illegal. Management have no rights to settle any issues related to money or additional charges out of the court. You can file a case against the management for fraud cases or can raised your voice in society meeting.
