Can builder recover development charges from purchaser and if so at what rate as per prevailing rules in Mumbai.
Q: Please advise me on the current legal position relating to recovery of Development Charges from Purchaser. If it an be recovered at what rate and on what area
Development charges of Rs 350/sq-mt. for residential and Rs 700/sq-mt. for commercial. Since the builder is demanding the charges at the time of formation of the society you need to find about the amount each flat owner has to pay based on the carpet area (not built up area) of the flat.
Hi, 1) Does the registered sale deed executed by the builder mention the legal development charges, maintenance expenses to be recovered?
2) If there is no such clause, builder can not demand additional amount from flat owners.
3) If these charges are not mentioned in your agreement, refuse to pay and file complaint before consumer forum against builder and seek orders to direct builder to hand over possession of flat to you.
Hello Sir, The development charges in Mumbai is Rs. 35/sq-ft. or Rs. 350/sq-mtr. as per the Maharashtra Government and you have to calculate on Carpet area and not in built-up area.
