Omkar Alta monte is said to be on a part of cemetery land??

Q: Have seen in some posts that alta Monte is build on part of cemetery land. Wanted to know was this cemetery active before the land was occupied. And what will be build on this cemetery land now. Is BMC allows to have cemetery land near residential housing? Will this cemetery be given to public to be in use after project is completed?

Dear Madhuika & Vinay Dixit Ji In this SRA Project the Cemetery is an Reservation And in this project Hindu Cemetery is treated as Buildable Reservation And Vinay ji if it is an Buildable reservation in that case the plot area is going to be handed over to BMC is absolutely correct as per Appendix IV of the Development Control Rule 33(10) This is no manipulation of numbers at all in this case But at the same time The developer has manipulated some facts no doubt in that. As you can see in the website of Omkar alt monte there is a tab of location of the project the developer has smartly shown the upcoming public amenity Metro station but he didnt shown there is a cemetery which is also an public amenity

As per Omkar Realtors and Developers, there were no irregularities in the project. It said it had no role to play in the eligibility issue as the matter is between slum dwellers and the authorities.
But a FIR had men tioned only Rs 150 crore but was later changed to Rs 415 crore. “Out of said 1000 sq yards, the SRA has declared area of 750 sq yards as slum under Maharashtra Slum Act. The matter is presently pending with City Civil Court and High Power Committee (HPC) appointed by High Court. No incre mental FSI is granted by SRA to the devel oper

But EOW is saying that they are looking into all the aspects of the case. Firstly, they will go through the documents and they decide on further course of action.
I don't know about the project whether the construction work is going on or on hold.

Hi Madhuika,
According to Appendix 4 of the Development Control Rules 33 (10), a developer who utilises cemetery land for redevelopment is supposed to return 25% of the original plot area after the project. This means for the above plot, Omkar Realtors had to give back 1496.90 sq- mtr to the SRA.

In a slum redevelopment project in Malad (East), the Slum Rehabilitation Authority (SRA) did some innovative calculations and let the builder (Omkar Realtors) to keep a big chunk of land, which was originally a cemetery.
However, the SRA’s calculations told Omkar they only had to give 498.99 sq-mtr this means the builder would give back only 8% of the original cemetery plot, instead of the mandated 25%, keeping a mammoth 92% for himself.
