2 BHK Mumbai Mira Road. Loading and Other Things.

Q: I had booked a 2 BHK of 950 sq ft in Mira Road Mumbai. IN agreement carpet is listed as 580. The building is ready but when we saw the flat, we felt disappointed. Kitchen was just 6.6 x 6.6. The balcony was just something one person can stand straight. There is no space to keep a washing machine also. Loading was close to 45%. I earlier used to stay in 1 BHK which had a balcony also in living room and Kitchen also. I feel the builder has cheated us in terms of carpet area. How can a 2 BHK flat have balcony equal to none and no space for washing machine also. Kitchen also is so small that only one person can stand at one time.

Hi Naveen,
Before booking your flat, you did not clear all those terms with the builders? What is your agreement saying? I think you should ask to the builder to show you blueprint. May be you will get the truth behind it. What is the view of other flat owners in this issue?

Hi Guys. Thnx for your reply. I added the entire flat sq ft like this -
Living room is - 10 x 14.6 = 146 sq ft.
Kitchen - 6.6 x 6.6 = 43.56 sf ft.
Bedroom 1 - 9.6 x 12.6 = 120.96 sq ft
Bedroom 2 - 9 x 12.6 = 113.4 sq ft
Toilet 1 and 2 - 4 x 6.6 = 26.4 (2 times ) = 52.8 sq ft
Wardrobe - 2 sq ft each = 4 sq ft
Dining - 7 x 7.6 = 53.2 sq ft
Passage - 3 sq ft
Total comes to - 536.92. This is what we get manually.
Now This is exact words mentioned in our agreement copy ----------
Flat carpet area is 582.00 sq ft i.e equivalent to __ __sq meters on the 3rd floor in building 2 Type B1 and Car Parking No- _ __on the ground / Stilt of the Building.
Builder has told us that if we want dedicated parking we need to pay 5 lacs or else we get common open parking. This building has 2 layers of Stilt parking.
What we get manually and what is listed in agreement has different carpet area and also it mentions that car parking. So the difference (582-536.92) of 45.08 odd sq ft goes where

Yes, the example below will illustrate trick used by builders or developers, when they say you can find carpet area by applying loading factor on the saleable area.
Saleable Area: 1200 sq ft
Loading Factor: 25% (or 1.25)

Wrong Method (favours seller):
Carpet Area: 1200 x (100-25)% = 1200 x 75% = 900 sq ft
If you apply 1.25 or 25% loading, saleable area should be 900 sq ft + 900 x 25% = 1125 sq ft
As you can see under this method builder is charging you for 1200 - 1125 = 75 sq ft more.

Right Method (favours buyer):
Find carpet area first by measuring actual dimensions, and then apply loading factor
Saleable area = 900 sq ft + 900 x 25% = 1125 sq ft

Hi Naveen,
If it is a residential project the loading is normally 33-35% and more in residential. You may always add the measurement of any size in the layout. The reason to the loading factor is these days the FAR plays a major role and the builder has to take out the lift and lobby place in project he is making. If you go to any construction site and ask them for the blueprint what the authorities has passed. it will tell you the exact loading.
