Q: Hello, I have two 1 BHK flats attached internally. However as per Index 2 and property tax bill it is a single flat. Now I am using one 1 BHK and second one is rented out. Please tell me, as per law can society charge me double maintenance. Thanks you.
Maintenance Charges has to be calculated in compliance of the law only.. it can not be doubled.
like water charges with respect to the count of water tap, it may double if you have two bathrooms than other 1 bhk. electricity as equal to the flat occupant - this will remain single as you have one unit only
If you have one flat in your name then society can technically send you one bill and you have to pay only one bill. One solution for the same is convincing society to raise the bills on per Sq-Ft (on area) basis. In this case, almost all maintenance heads are apportioned on flats carpet area and thus bigger the flat bigger is the bill. This is very fair system which is adopted by many societies.
Yes, I am agreed with Abhijit.......If the sanction plan of that building shows one flat only for the same premises which you have purchased under one agreement, then you can prove them it is one flat, not two.
I would like to suggest you to check your society registration documents made with Registrar. If 2 share amount is paid then your society is right. Visit your nearby registrar office and confirm it first before paying maintenance charges.
