Builder restricting access to Terrace

Q: The builder all of a sudden during the maintenance agreement adds a clause saying no one can have access to Terrace. By this he also has restricted installing DTH antennas and forcing me to use the service provider he has chosen

So what we have to do? Wanna Watch that worst non HD channels! Now a days we can select our channel pacakages but you guys are forcing us to watch your channels list. No one will likes to live in ur appartment if this condition exists.

It is planned to install the Solar Panels in the Terrrace, since it is a Green Building and there is a Platinum Award from Indian Green Building Council to SSM Nagar Residents. If Owners are having access, then Children may damage the Solar panel or Owners will dry their Washed Clothes in the Panels. Repairing or Replacing the Solar Panel is an Additional Cost. Children Safety is the another Reason.

Hello Deepak,
Terrace form part of common area for benefit of all members and no one can claim ownership to it exclusively. Restricting access to Terrace is illegal. You may issue a legal notice falling which you may drag him to civil court with a mandatory or to consumer forum for necessary relief.

A terrace or rooftop is a common area of in a residential society which is for the enjoyment and benefit of all its members. You would need order from consumer forum to direct builder to grant access to all residents to terrace and installing DTH Antennas.

the builder won't listen at all for any issues. we unfortunate people still obey his words as our kids are studying in his school. tragedy
