We have lost the builders agreement for a flat bought in 1989 (before registration was compulsory) Now we want to sell.

Q: We have all the original receipts of payments made to builder, possession letter and sale deed for undivided share of land. Will an affidavit saying we lost builders agreement be enough?

Hi,
It is better you can apply the certified copies in the Sub-Registrar with respect to the copies of the lost documents.
The seller has to lodge a police complaint stating that the sale deed has been lost and also make an affidavit to that effect and also make newspaper publication with respect to the lost documents.

Yes, i agreed with Uday. The first step is to lodge a police complaint. Thereafter, issue a public notice in two leading newspapers, preferably in an English language and a local one, stating the loss of document. File an application for share certificate and and register those copies with the notary. To collect duplicate proof of property ownership, you can get a certified copy of the original sale deed from the office of the concerned sub-registrar of assurances, where the documents were registered.

1) File a police complaint immediately, 2) Publish an advertisement in local newspaper, 3) File an application for share certificate, 4) Register with the notary, 5) Get the duplicate sale deed.
