Q:I have an agreement for buying a 3Bhk Flat with A builder but now my son is not willing to buy this one , We have booked by booking Money Rs.11 lakhs and its Super built up area approx 1370 sqft wit covered car Parking our Agreed Price means consideration Value is Rs.5331000/- and now as my son is interested to buy A flat of 3Bhk in a complex in Parnasree Area Kolkata,My query is that if any interested Builder/Promoter can take over my booked flat by offering the new one in their complex by adjusting my Previous Booking Money of 11 Lakhs.Can it be done legally.

First problem: SELL the existing 3 bhk flat.
Second problem : BUY a new apartment in Parnasree Area Kolkata,
I hope your agreement is not registered. You should check the clause regarding the property selling in your agreement provided by the builder, as the builder must have asked you some xyz money to change the name of the property owner in the documents. You can List property for sale on commonfloor to find a genuine buyer.
Now regarding buying a new property at Parnasree Area Kolkata, I would suggest you to consult the builder of the property or check if any property is available for resale.
