Q: I had booked a flat in CASUNIVIS CIELO in November and has been closely monitoring the progress of the project and now have developed a opinion that LODHA is not a reliable builder to go with at present.
The descrepancies noted sofar
1)they are way behind their schdule
2)No registrations done so far against as promise to be done in feb 2010
3)No demand has been requested so far and suddenly they will come up with a demand for huge amount
4)Referral program is a farce
5)No replies to your querries or emails
6)All individual has a different terms and conditions in thei agreement.Whne self had booked I was told that if the project is delayed by more than 6 months than LODHA will be paying back to the investors at 12%.This clause is included in few allotment letters and not in others for flats booked on the same date.
7)Constuction is in FOREST LAND and they have not got the clearance though they claim that they have all the clearance
8)Cluster AERIS AND TIERRA has not got approv
1) Agree, they are way behind in schedule by an year
2) Lot of flats have been registered in CASA Univis, including mine in Tierra which was registered in 2009. Yours should also get registered soon.
3)They will not demand any money till they have all approvals, which seems to be fair.
4) I have successfully recieved a gift from referral program, however took some followup.
5)I have got prompt replies to my emails till now, you can contact the customer service manager directly if your queries are not being answered.
6)Terms and conditions vary in allotment letters because differrent level of status/information is known to the builder at different times, he put whatever is best known at the time of allotment and hence the variation. Even if the delay compensation clause is not there in allotment letter, you should insist that it should be there in the agreement and that will protect you against the losses.
